24 star Kiefer Sutherland will not stand trial for allegedly headbutting designer Jack McCullough, a spokesperson for the Manhattan district attorneys office confirms to EW. The office conducted “a thorough investigation” into the matter, according to the spokesperson, who added that the DA had found McCullough to have been “quite uncooperative.”

Suddenly, I find myself counting the minutes until 24’s new season. Perhaps this is why: Katee Sackhoff is joining the cast!

Sources confirm to me exclusively that the Battlestar Galactica heroine has been tapped to play the series regular role of Dana Walsh, a highly respected and down-to-earth data analyst at the new and improved New York branch of CTU.

This fraktastic casting coup hit a road block last week when Sackhoff abruptly took herself out of the running, prompting me to post this blind item. But late Friday, word surfaced that the BSG badass was once again in the mix.

Here’s more scoop on Sackhoff’s character…

She’s in a relationship with fellow agent Davis Cole (played by the just-cast Freddie Prinze. Jr.), and she apparently has a skeleton in her closet she’s trying desperately to keep hidden.

As I previously reported, 24’s eighth season — which premieres Jan. 17, 2010 — will be set in the Big Apple and center on an assassination plot against a visiting foreign leader (Slumdog Millionaire’s Anil Kapoor). In addition to Sackhoff and Prinze, new Day 8 blood includes Forrest Gump’s Mykelti Williamson, Kissing Jessica Stein’s Jennifer Westfeldt (as a journalist with ties to Kapoor’s diplomat), and The Starter Wife’s Chris Diamantopoulos (as President Taylor’s Chief of Staff).

Sources said Prinze is joining the cast of Fox’s “24″ as a regular, playing Davis Cole, a recently returned Marine who runs CTU Field Ops and wants to follow in Jack Bauer’s (Kiefer Sutherland) footsteps.

On the real-time drama, whose upcoming eighth season started production Wednesday, Prinze joins fellow new cast additions Anil Kapoor, who plays a Middle East leader; Chris Diamantopoulos, as the president’s new chief of staff; and John Boyd as a CTU systems analyst. All of them are regulars, while Jennifer Westfeldt has come aboard as a recurring, playing a a journalist.

Also cast as a recurring on the 20th TV/Imagine series is Nazneen Contractor as Kapoor’s daughter.

Kiefer Sutherland Assault Charge May Be Dismissed

Kiefer Sutherland and the alleged victim of a headbutting incident have resolved their differences, clearing the way for an assault charge against the actor to be dismissed.

Sutherland apologized to fashion designer Jack McCollough, who had claimed the 24 star broke his nose in a scuffle at a New York nightclub May 5.

“I am sorry about what happened that night and sincerely regret that Mr. McCollough was injured,” Sutherland said in a joint statement released to the Associated Press.

McCollough said in the statement: “I appreciate Mr. Sutherland’s statement and wish him well,” according to AP.

The resolution of their differences increases the chances the Manhattan District Attorney will ask the judge that the case be dropped. Sutherland, 42, was charged with third-degree assault, a misdemeanor. Sutherland’s next scheduled court is June 22.

Sutherland, who’s currently serving a five-year probation term for a second DUI conviction, may not be off the hook with L.A. prosecutors, who’ve stated their intention to review the New York case as a possible probation violation and could seek possible jail time.

“We have requested the incident report from NYPD and we will assess the situation when we have all the available information,” L.A. City Attorney spokesman Frank Mateljan tells PEOPLE.

Chris Diamantopoulos — best known as Debra Messing’s gay BFF on The Starter Wife — has been tapped to play the series regular role of Rob Weiss, the argumentative and tough new Chief of Staff to President Allison Taylor (Cherry Jones). He replaces Taylor’s current C.O.S., Ethan Kanin, who snatched his job back in last Monday’s finale after the prez’s psycho daughter, Olivia, was taken into federal custody.

As I previously reported, Day 8’s action will switch from Washington D.C. to New York City and center on an assassination plot against a visiting foreign leader (Slumdog Millionaire’s Anil Kapoor, the new season’s first piece of casting).

Kiefer Sutherland rose to Brooke Shields’s defense early Tuesday morning in Downtown Manhattan – though she didn’t particularly request it, and the interloper allegedly suffered a broken nose from the 24 star, according to reports.

“There was an incident that occurred at 2 a.m. at 99 Prince [Street],” a NYPD spokesperson tells PEOPLE. “It’s all under investigation by the police department … People will come in sometime this afternoon [to be questioned].

New York’s Daily News reports that Proenza Schouler women’s wear designer Jack McCollough – a friend of Shields’s – interrupted her and Sutherland while they were speaking outside the SoHo nightspot SubMercer, resulting in an agitated Sutherland allegedly headbutting McCollough after the two men exchanged words.

Witnesses also say Shields was shoved but not hurt. All were out for an after party following the Met’s Costume Institute Gala, and a rep for Shields denied she had anything to do with the alleged headbutting. “Nothing happened to her … Jack did nothing inappropriate. It’s not clear what caused Kiefer to do what he did,” the rep told TMZ.com.

The designer reportedly received a minor cut on his nose. McCollough is quoted as telling authorities that Sutherland “was drunk and obnoxious and wouldn’t back down or be logical,” and that the actor “pulled this stupid wrestling move like a teenager” before the headbutt.

Police and friends of Sutherland’s told the News that Sutherland was intoxicated. The paper says that both Sutherland, 42, and Shields, 43, are expected to speak to the police on Wednesday.

After six seasons in Los Angeles and one in D.C., Jack Bauer is taking his one-man show to Broadway!

Sources confirm to EW that 24 will be relocating to New York next season — at least on screen. (The show will still be primarily shot in Los Angeles, with some NY location footage mixed in.)

Production on Day 8 gets underway next month, but already details are emerging. In addition to the move to the Big Apple, CTU will make a comeback under the leadership of a new, yet-to-be-cast male character by the name of Brian Hastings. Described as an MBA type with a razor sharp intellect, Hastings will be joined by two new twentysomething agents (one male, one female), as well as Mary Lynn Rajskub’s returning Chloe.

As previously reported, Slumdog Millionaire’s smarmy game show host, Anil Kapoor, is joining the cast as Arman Hashemi, a Middle Eastern leader on a peacemaking mission in the U.S. Casting is underway for the roles of his brother and wife.
